JASSFERRY Terms & Conditions

These terms and conditions apply to any purchases you make from us.

  1. DEFINITIONS

1.1. In these conditions:

‘condition’ means the standard terms and conditions of sale set out below, including any special terms and conditions agreed in writing by us;

‘contract’ means any contract for Goods made between you and the company;

‘goods’ means the packaged products or services which we shall supply in accordance with these Conditions;

‘JASSFERRY/our/us/we’ means our JASSFERRY TEAM;

‘you’ means the customer seeking to purchase the Goods from us and ‘your’ shall be construed accordingly.

  1. 1. CONDITIONS RELATING TO IN STORE PURCHASES

2.1. The price of the goods shall be the price given on the date you place your order and will be confirmed on your invoice and it will include VAT at the prevailing rate.

2.2. Delivery charges may be applicable to your order. Please ask in store for details.

2.3. We strive to ensure that our prices are accurate but in the event that there is an error we will notify you prior to accepting your order or providing you with a formal quote (see further below).

2.4. We guarantee to hold the price of the Goods on your quote for 28 days from the date of your quotation.

2.5. We allow some orders to be placed on the payment of a deposit. Where this is the case:

  • you shall pay the deposit to secure the agreed price for 28 days;
  • before or at the end of those 28 days you must pay the full outstanding balance. If you fail to do so we reserve the right to refuse (i.e. cancel) your order.
  • When you have paid the full balance we will secure stock to fulfil your order and a store colleague will advise you of an ‘expected by’ delivery date. Your order is accepted by us at this point (we do not secure stock on the payment of a deposit or before we have accepted your order).

2.6. Unless you are placing a deposit order you shall pay for the Goods at your local JASSFERRY in full at the time you place the order. At the point of full payment, you will be advised by a store colleague of an ‘expected by’ delivery date. When all the stock is available and reserved to your order, our delivery partner will contact you to arrange a delivery date.

  1. CONDITIONS RELATING TO WEBSITE USE AND PURCHASES

3.1. Your use of our website, including any transactions you make, is subject to these conditions, our cookies policy and privacy policy (both of which can be found on our website).

3.2. When you place your order you will be diverted to the order 'confirmation' which sets out the final details of your order. Following this, we will send to you an order acknowledgement e-mail detailing the products you have ordered. Please note that your order confirmation and acknowledgement is not an acceptance of your order by us.

3.3. Acceptance of your order and the completion of the contract between you and us will take place on dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it.

3.4. Please print out these terms and conditions and your order acknowledgement for your own records as we do not file details of your order for you to subsequently access direct on this website. If you wish to obtain specific details of your previous orders please refer to Contact us and FAQs.

  1. CHANGES TO YOUR ORDER BEFORE DELIVERY

4.1. For in store purchases, you can make changes to your quote, or a deposit order up until the point of full payment. When we have received payment we are unable to make any further changes to the order (you may be entitled to cancel, see further below).

4.2. For all other orders, if your order includes items classified as:

  • ‘large items’ for delivery you can make changes PRIOR to booking a delivery date. To do this we will need to cancel your order and re-raise a new order and this may change the ‘expected by’ delivery date.
  • Should you wish to re-arrange your ‘large items’ delivery date, you must contact your localJASSFERRY five days prior to your arranged delivery date. This is not a guaranteed service, but we will attempt to make amends where possible.
  • ‘small items’ for delivery, we are unable to make any amendments.
  1. DELIVERY

Deliveries are to UK mainland and Ireland only

5.1. Our home delivery service options and pricing will be explained at the point of order in store or online.

5.2. Home deliveries are generally made between 7am and 8pm. A convenient delivery date will be agreed with you after you have placed your order.

5.3. You shall be responsible for making all necessary arrangements to take delivery of the goods.

5.4. Any specific, or exceptional, delivery requirements should be agreed with your local JASSFERRY at the point of purchase.

5.5. If you fail to take delivery of the goods or fail to give us adequate delivery instructions on the date agreed for delivery, then we reserve the right to charge you the subsequent delivery charges.

5.6. We recommend that you do not confirm the start date with your installer until you have received and checked your delivery. JASSFERRY will not accept liability for any additional costs that you incur as a result of you booking an installer prior to receiving and checking your goods and while any product issues are resolved.

5.7. Risk of damage to, or loss of the goods shall pass to you at the time we deliver to your agreed delivery address.

Delivery Options

5.8. While the majority of our products will come on one delivery, we do work with some trusted suppliers to deliver goods direct to our customers. This will mean that if you order multiple items you may receive more than one delivery. You will be contacted directly to arrange all deliveries. However, you will only be charged one fee (if your order includes a Large Item Home Delivery product, you will be charged the higher delivery charge, unless your order is over £500 in which case the delivery is free).

Large Items Delivery

5.9. Many of our products, including baths and shower enclosures, require special handling due to their size and weight. To give a great customer experience, we’ve developed our Large Items Home Delivery service which includes the following features:

  • Choice of delivery dates
    Once you have placed your order, you will be contacted by our delivery partner to select a delivery date.
  • Room of choice
    Your products will be delivered to a room of your choice. Prior to delivery please ensure you have cleared some space to store your items.
  • Reservation of stock
    Your stock will be reserved once all items are available, at which point our delivery partner will contact you to arrange a delivery date.
  • 14-day lead time
    Large Items Deliveries are usually made within 14 days.

Many of our products can be delivered via a small items delivery service. To give a great customer experience, we will send your products out for delivery as soon as all items are available. You will be notified via text when it’s on its way.

  • Reservation of stock
    Your stock will be reserved once all items are available, at which point your order will be sent out to you and you will be advised when it will arrive by text from our delivery partner.
  • 7-day lead time
    Small Item Deliveries are usually made within 7 days.

Pre-assembled & flat packed

At JASSFERRY we like to ensure you know exactly what you are getting. During our delivery service, some items may come pre-assembled, while others will come flat packed. Please visit the product page for the item to determine if it is pre-assembled or flat packed. This should be detailed on your invoice or order.

  1. LOSS OR DAMAGE TO GOODS ON DELIVERY

6.1 When you receive the goods please open each box and check that everything is as ordered and appears in good condition. If there are any items missing or damaged please contact JASSFERRY as soon as possible but no later than seven days from the day after delivery. We will arrange for a replacement item to be delivered to you free of charge.

6.2 If receiving multiple deliveries, the 7 day checking period will commence from the day after the delivery of each individual item.

6.3 Where an item has been replaced by JASSFERRY, the damaged goods will not be collected.

  1. CANCELLATION RIGHTS – GOODS ORDERED INSTORE, VIA THE INTERNET OR TELEPHONE

7.1 You will be entitled to cancel your contract with us in the following circumstances:

  • Internet, telephone and store orders where goods have not been installed and you are unhappy with the goods, for whatever reason, and notify us before the expiry of 30 days from the day on which the goods were received; or
  • Where goods supplied are faulty or not in accordance with the specifications of your order.

7.2 A refund will be reimbursed to you within 30 days from the day after the day on which the cancellation was made. This is subject to us being given reasonable opportunity to collect the goods.

7.3 You are obliged to take care of any products that you intend to return to us. We ask you to ensure that returned items are complete and in the original packaging. Prior to collection we will ask for evidence the item is in its original packaging before we arrange a collection.

7.4 You will be responsible for the £50 cost of collecting unwanted large items, this will be deducted from the value of the product being returned, once we have confirmed receipt of the goods. Please ensure you are available on the day of collection as we will not collect items without also receiving a signature.

7.5 We cannot refund goods that have been damaged while in your possession.

7.6 We cannot accept small product returns in all of our stores due to space limitations, if you would like to return a small item, we can arrange this from your home. We cannot accept large items returned to stores, we will arrange this to be collected from your home at a cost of £50. Some fragile small items may require a large items collection service due to the value or fragility.

  1. WARRANTY AND LIABILITY

8.1 Proof of purchase is required before any warranty claim can be assessed. Guarantees are non-transferable with a change of ownership.

8.2 We shall make good by reimbursement of the whole or part of the price or, at our option, by repair or by replacement any defect developing under normal domestic use of the goods within the stated guarantee period for the product affected.

8.3 Our liability for death or personal injury caused by our negligence shall be unlimited and for all other loss or damage which you may suffer or incur in connection with the supply of goods, our liability shall be limited to that caused by a natural and reasonably foreseeable consequence for which we are at fault or negligent.

  1. GENERAL

9.1 We shall have no liability whatsoever for any failure to perform, or for a delay in the performance of any of our obligations under the contract arising wholly or in part by reason for any factor beyond our direct control.
9.2 In placing an order with us, you warrant that you are a resident of the United Kingdom and that you have the necessary permission and authority to enter into this contract.
9.3 Where any competent authority deems any condition to be invalid or unenforceable in whole or in part, then the offending part shall be removed and the validity of the remainder of the condition shall not be affected.
9.4 These conditions do not purport to confer a benefit on any third party by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person that is not a party to it.
9.5 The contract and these conditions shall be governed by the laws of England, and you agree to submit to the non-exclusive jurisdiction of the English courts.
9.6 Any notice required or permitted to be given by either party to the other under these conditions shall be in writing addressed to the other party and delivered to the address provided at the time the order is confirmed or any subsequent or alternative address which one party may notify to the other from time to time.
9.7 The terms and conditions do not affect your statutory rights.

  1. PRODUCT GUARANTEES

10.1 On all new orders raised after the 22nd July 2019 JASSFERRY will replace any faulty product delivered or offer a refund.

10.2 Where you have purchased products prior to the 22nd July 2019 please contact us for more information

10.3 All products are covered by the specified guarantee at no extra cost and without application for extension. You can find out each individual guarantee by viewing the product specification on our website.

10.4 JASSFERRY reserves the right to change the guarantee periods or amend the list of exclusions without notification however, all guarantee periods published at the time of full payment, or financial agreement arranged, will be honoured upon proof of purchase date.

10.5 All JASSFERRY products are engineered & manufactured to exacting standards and carry our additional guarantee over your statutory rights covering all manufacturing faults.

How to Claim:
In the unlikely event that you encounter a problem with a JASSFERRY product you should contact your local JASSFERRY. They will be able to advise whether it is due to faulty product or faulty installation. If the problem is due to a manufacturing fault, they will arrange the supply of a replacement product.

Our Guarantee:
We will replace at our discretion, in part or whole, a product which is defective in operation or materials. If the exact model is no longer available, we will endeavour to provide the nearest equivalent from our then current range. To be covered by the guarantee, all products should be installed in accordance with the instructions provided and be for domestic use only. Products must be purchased and installed in the UK and Ireland only. This product guarantee applies to the original purchaser or end user and the original installation address only, is non-transferable and takes effect from the date of purchase. The guarantee does not cover damage during fitting, accidental or malicious damage, improper use or negligence, discolouration due to prolonged exposure to sunlight or UV light, general wear and tear (for example light bulbs, hinges, cartridges & shower hoses are items that do need to be replaced periodically), damage due to poor installation or servicing or consequential loss. Shower hoses, taps and shower cartridges & furniture hinges are guaranteed for one year. Care should be taken in hard water areas to ensure that cartridges are regularly cleaned. We require original proof of purchase to be provided for us to be able to consider any claim, so please keep your invoice and/or receipt.

JASSFERRY reserve the right to alter the details of, or wholly withdraw elements of these guarantees entirely at their discretion. Existing commitments will be honoured up to the date the change is made and in accordance with the terms as set out here.

Our Guarantee is in addition to your statutory rights and does not affect your statutory rights.

JASSFERRY are continually improving products and reserve the right to alter specifications.

Ex-Display Products:
Products sold as ex-display have been installed in our stores and may well have scuffs and cosmetic damage consistent with normal use. Please examine the product thoroughly before leaving the JASSFERRY as all ex-display are sold as seen and cannot be refunded once removed from the store.

Ex-display products are sold without JASSFERRY's Guarantee. This does not affect customer's statutory rights.
